Lift Buddy — Privacy Policy

This Privacy Policy applies to the Lift Buddy mobile application (the App) and the website at www.liftbuddy.info (the Website), together the Service. It explains what personal information we collect, how we use, hold and share it, and the choices and rights you have.

1. Who we are

The Service is operated by Bahae Darwich Alameddine trading as JB Networking ABN 91 314 798 806 (Lift Buddy, we, us or our). We are responsible for the personal information we handle in connection with the Service.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and, to the extent it applies to us, the Health Records and Information Privacy Act 2002 (NSW) and the Health Privacy Principles.

2. About this Policy

By creating an account or using the Service, you agree to the collection, use and disclosure of your personal information as described in this Policy. If you do not agree, please do not use the Service. This Policy should be read together with our Terms of Use.

3. The information we collect

The kinds of personal information we collect depend on how you use the Service. They include:

SubscriptionSubscription status and transaction identifiers. Billing is handled by Apple, Google and our subscription provider; we do not receive your full payment-card details.
Apple Health / Health ConnectHealth and fitness metrics (such as steps, active energy, resting heart rate and body weight) that the App reads from Apple Health (iOS) or Health Connect (Android), with your permission, to show your activity and personalise your coaching.

We do not use this information for advertising, and we do not share it other than as needed to provide the Service. We do not send these Apple Health or Health Connect metrics to our AI providers. You can revoke access at any time in your device settings.
Voice InputAudio captured through your device's microphone when you use the voice input function. This is then converted to text.

4. Types of information

The Privacy Act 1988 (Cth) distinguishes between different types of information.

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable:

Sensitive information is defined in the Privacy Act as including information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information. Some of the information you provide through the Service (such as your body statistics, training, diet and sleep) is health information, and is treated with a higher level of protection. 7. Consent and your health information

Because the Service involves health information, we rely on your consent to collect it. You provide that consent when you enter the information as part of setting up and using the Service. You can withdraw your consent at any time by ceasing to provide the information, adjusting your permissions, or deleting your account (although some features may not function without the relevant information).

Lift Buddy is a fitness and wellness tool. It is not a medical service and does not provide medical advice, diagnosis or treatment. 8. AI Processing

To generate coaching responses, your messages and a summary of your profile and memory are sent to our AI provider, Anthropic (the Claude API). Anthropic processes this information on our behalf in order to return a response and does not use information submitted through its API to train its models. We send only the information needed to produce a helpful, personalised response.

Responses generated by the AI coach are automated and general in nature. They are not professional, medical or health advice, and should not be relied on as such.

We share personal information with service providers who process it only on our instructions and for the purposes described below:

We may also disclose personal information where we are required or authorised to do so by law, to protect the rights, property or safety of any person, or as part of a sale or transfer of our business. If we sell or transfer all or part of our business, we may disclose your personal information to the purchaser or proposed purchaser. Any recipient will be required to keep it confidential and use it only for the purpose of the transfer, and to handle it in accordance with a privacy policy. Where the information includes health or other sensitive information, we will only disclose it in accordance with the Privacy Act, which may require your consent or that that information continue to be handled for the same purpose for which it was collected.

10. Direct marketing and communications

We may send you communications about the Service, including updates, offers and content we think may interest you, where you would reasonably expect to receive them or where you have consented. Every marketing communication includes a simple way to opt out, and you can change your notification preferences at any time in the App or your device settings. We do not use your sensitive information for direct marketing.

11. Cookies, analytics and tracking

Our Website and App use cookies and similar technologies to help them function, to remember your preferences, and to understand how the Service is used. Most browsers allow you to refuse or delete cookies. If you elect to delete, some parts of the Website may not work properly. We do not use these tools for third-party advertising profiling.

12. Overseas Disclosure

We store your information on our providers' secured infrastructure, using access controls and row-level security so that users can access only their own data. We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure.

Some of our service providers are located overseas, principally in the United States. This means your personal information may be disclosed to, stored in, or accessed from, those countries. Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles it consistently with the APPs and this Policy.

13. Retention

We keep your personal information while your account is active. This includes any food photos you submit, which we retain while your account is active unless you delete them earlier. You can delete individual memories in the App, and you can request deletion of your account and associated data at any time by using the in-app delete option or emailing app@liftbuddy.info. We will delete or de-identify your information within a reasonable period, except where we are required to retain it to meet a legal obligation or to resolve a dispute.

You may request access to the personal information we hold about you and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading (Australian Privacy Principles 12 and 13). To make a request, contact us at app@liftbuddy.info. We may need to verify your identity before acting on a request, and there are some circumstances in which we may be unable to give access or make a correction, in which case we will explain why.

We maintain measures to detect and respond to data breaches. If a data breach occurs that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth).

The Service is intended for people aged 18 and over. It is not directed to children, and we do not knowingly collect personal information from anyone under 18.

Because the Service is limited to adults, under-18s are not permitted to create an account or use the Service, and we do not rely on parental or guardian consent. If we become aware that we have collected personal information from a person under 18, we will delete it as soon as practicable. If you believe a person under 18 has provided us with personal information, please contact us at app@liftbuddy.info.

18. Users outside Australia

The Service is directed to users in Australia. If you access it from outside Australia, you do so on your own initiative and are responsible for compliance with your local laws.

19. Complaints

If you have a complaint about how we have handled your personal information, please contact us at app@liftbuddy.info. We will acknowledge your complaint and aim to respond within a reasonable time, usually within 30 days. We may ask for further information to help us investigate.

If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner at oaic.gov.au.

20. Changes to this Policy

We may update this Policy from time to time. If we make a material change, we will notify you in the App or by email, and we will update the “last updated” date above. Your continued use of the Service after a change takes effect means you accept the updated Policy.
